Most of the methods of compliance require the filing of Financial Responsibility Insurance (SR-22), which must be maintained for 36 months. Cancellations of the insurance will result in a driver's license suspension (Type Action 05). The type action for an Unsatisfied Judgment suspension is a 06. Unsatisfied Judgment Suspensions will require a $70 reinstatement fee. The methods of compliance for Unsatisfied Judgment include:
- Installment Order
The Installment Orders come from the court and basically allow the uninsured motorists to pay the judgment by installments. The order must be certified or file-stamped by the court in the county of jurisdiction and submitted to our office for acceptance. (Authority: 625 ILCS 5/7-312)
- Satisfaction of Judgment
This is a court document that states that the Judgment has been paid in full. The document must be certified by the court or must be filed stamped. This type of document is also sent after an installment order has been satisfied (Authority: 625 ILCS 5/7-311)
- Bankruptcy
Bankruptcies can only be accepted from a bankruptcy court. Once the proper documentation has been received, the Secretary of State's office will stop any action against the individual. (Authority: 625 ILCS 5/7-310) Please note that Bankruptcy cannot be accepted in alcohol-related cases (11 USC 523, item 9).
- Chapter XIII Wage-Earner Plan
These court documents state that money will be deducted from the uninsured motorist's wages to be applied toward the damages that resulted from the crash. (Authority: 625 ILCS 5/7-310)
- Court Order for Non-renewal of Judgment (Dormant Judgment)
A certified or filed stamped court order showing that the case has not been renewed within seven (7) years from the entry date of the judgment can be accepted as a method of compliance. These documents are commonly referred to as "half sheets." (Authority: 625 ILCS 5/7-309)
- Vacating Order
A vacating order is an order from the court to remove the unsatisfied judgment suspension. Upon receipt of the certified or file stamped vacating order, the suspension will be deleted from the individuals driving record and financial responsibility will not be required. No reinstatement fee is required for this method of compliance. (Authority: 625 ILCS 5/7-309)
