Annexation
Forms Overview
First, is an individual parcel petition under 75 ILCS 16/15-10,
then a group petition from owners to voluntarily annex
to the library. In both respects, there is also an ordinance form
for the Library Board to pass approving either form of an individual
or group annexation petition. Note at the end of the ordinance,
the steps are indicated which must be taken for filing with the
Recorder and County Clerk (including a map) for proper completion.
Second, is an individual parcel petition under 75 ILCS 16/15-30,
then a group petition from owners to voluntarily annex
to the library. In both respects, there is also an ordinance form
for the Library Board to pass approving either form of an individual
or group annexation petition. Note at the end of the ordinance,
the steps are indicated which must be taken for filing with the
Recorder and County Clerk (including a map) for proper completion.
Third, is a sample ordinance under 75 ILCS 16/15-10(c) which can
be used on occasions where, although the owner of a new subdivision
will not object to an annexation, he will not voluntarily sign a
petition. This form of annexation will not work if there are actual
voters residing on the property. However, if this is private property
not yet developed, at the time the original subdivision is being
laid out, the Board can pass this ordinance and the owner can receipt
for the notice. Sixty days later, the annexation is effected for
the territory.
Fourth, is a form ordinance for annexing parts of a municipality
under 75 ILCS 16/15-35 with no voters residing therein, which does
not require a petition or a notice. Following is a form ordinance
to annex a contiguous street or highway under 75 ILCS 16/15-25,
and neither a petition, notice, or referendum is required.
Finally, is a copy of the ordinance and a notice of ordinance for
the form of annexing areas as they are annexed to the city, village,
town, or school district. There are some troublesome aspects to
this type of annexation, being that the annexed owners have opportunities
for front door referendum after they receive their tax bill or within
one year of the annexation. However, these are the forms that the
Board would need to pass an ordinance and then publish a notice
of that ordinance within 15 days. If no back door referendum petitions
are passed within 30 days, the annexation, at least temporarily,
is in effect. Section 3 of the ordinance details the activities
necessary, including map preparation, filing, and notice.
