Title and Registration
Any vehicle currently in or brought in to the State of Illinois to be titled from a county or state declared a natural disaster by the Federal Government must have a Natural Disaster Disclosure Statement completed, notarized and signed by either the registered owner or the insurance company representing the vehicle before a clean, unbranded Illinois Certificate of Title will be issued. If you are a self-insured entity, the fact must be stated on the Natural Disaster Disclosure Statement and disregard the completion of the insurance company's area.
Natural Disaster Vehicle Statutes for Dealers
The heavy rain and subsequent flooding may have affected vehicle a dealer's business and inventory. According to the Illinois Vehicle Code, any vehicle that has been submerged in water to the point that rising water has reached over the door sill and has entered the passenger or trunk compartment shall be designated as a "flood vehicle" (625 ILCS 5/3-117.1(b)(5)).
An application for a title with the correct flood designation, if applicable, should be done as soon as you are able to ensure compliance with the Illinois Vehicle Code and to avoid any possible sanction of a dealer's license per Section 5-501 of the Code (625 ILCS 5/5-501(a)). A violation of the Code, including buying, selling, exchanging a vehicle, or buying, selling, exchanging just the certificate of title to a vehicle, without the proper flood designation may result in a denial, suspension, revocation, or cancellation of a dealer's license.
In addition, if the vehicle has been submerged in water to the point that rising water has reached over the door sill and has entered the passenger or trunk compartment and the cost of repairing the damage, including labor, exceeds 33 1/3% of the fair market value of the vehicle prior to the flood event, shall be issued a salvage certificate with the "flood" designation. The flood designation on a certificate of title or salvage certificate shall be conspicuously entered on subsequent titles for the vehicle as well.
Any person that owns or possesses a vehicle that meets the designation of a flood vehicle or a salvage vehicle with a flood designation shall apply for title in accordance with Section 3-116 of the Illinois Vehicle Code (625 ILCS 5/3-116).
Failure to designate "flood" on an application for title is a violation of the Illinois Vehicle Code and may result in a fine of not less than $1,000 nor more than $5,000 for a first offense and a Class 4 felony for a second or subsequent offense.
